Terms

The terms for using Spark, the dictation app for macOS, and this website.

Effective 14 October 2026

1. About these terms

These terms are an agreement between you and Francesco Di Pietro, a sole proprietorship registered in Poland ("we", "us"). By installing or using Spark, you agree to them.

If you use Spark through your organization, your organization's agreement with us (for example, an accepted quote or order) covers the subscription: seats, period and price. These terms cover how you use the app. If the two conflict, your organization's agreement wins.

2. Access

  • Spark works only for people with access: today, people their organization has invited. You sign in with your email address and a one-time code.
  • Keep access to your email account secure, and don't share sign-in codes. You're responsible for what happens under your access.
  • Your access is tied to a limited number of your Macs, three by default. Signing out on a Mac frees its place.
  • Don't try to get around the sign-in, the access pass or the limit on Macs, or let anyone else use your access.

3. Your license to use Spark

While your access is valid, we give you a personal, non-exclusive, non-transferable license to install Spark on the Macs you sign in on and to use it for your own work or your organization's.

You may not:

  • copy, sell, rent, lend or redistribute Spark, or offer it as a service to others;
  • decompile, disassemble or reverse engineer it, except to the extent the law allows you to despite this restriction;
  • remove or change its notices, or interfere with its license checks or update signatures;
  • use it in a way that breaks the law or other people's rights.

Spark and its updates remain ours. Everything not expressly licensed to you is reserved.

4. Plans, payment and renewal

  • Enterprise. The number of seats, the subscription period and the price are in your organization's quote or order. We invoice for each period; invoices are due by the date shown on them. Prices exclude VAT unless stated otherwise. When a payment arrives, we extend your organization's access to the end of the period it covers.
  • Pro, for individuals, is coming soon. Its terms will be added here before it launches.
  • When a subscription ends. Spark stops recording the next time it checks your access online. A Mac that stays offline keeps working until the end of the paid period plus a 7-day grace period.

5. Your content

What you dictate and the text Spark produces are yours. Spark processes them on your Mac, and we never receive them. The history keeps only your most recent 100 dictations, so save anything you need elsewhere.

6. Speech recognition makes mistakes

Machine transcription is not perfect. Words can be misheard, missed or added. Spark inserts text wherever your cursor is, so check it before you rely on it or send it. Take particular care with medical, legal, financial and other important text. Don't use Spark where a transcription error could put someone's safety at risk.

7. Updates and changes

Spark updates itself automatically unless you turn this off. Updates can fix problems and add, change or remove features. If a change significantly reduces what an organization paid for during a paid period, the organization may end its subscription and we refund the prepaid fees for the rest of the period.

8. Third-party components

Spark includes open-source software and NVIDIA's Parakeet speech models, each under its own license. Those licenses apply to those components, and nothing in these terms limits your rights under them. See the acknowledgments.

9. Privacy

The Privacy Policy explains what personal data we process and why. The security and privacy page has the technical details.

10. Warranty

We work to keep Spark reliable, but we provide it "as is" and don't promise that it will be free of errors or work without interruption. To the extent the law allows, we give no warranties other than those in these terms. For business customers, this excludes the statutory warranty for defects (rękojmia). If you are a consumer, your statutory rights are not affected.

11. Liability

  • We are not liable for lost profits, lost data, or indirect or consequential losses.
  • Our total liability for all claims relating to Spark is limited to the fees paid for Spark in the 12 months before the event that caused the claim.
  • These limits don't apply to damage we cause intentionally, to personal injury, or wherever the law doesn't allow liability to be limited. If you are a consumer, they apply only as far as consumer law allows.

12. Ending

You can stop using Spark at any time by signing out and deleting the app. We may suspend or end your access if you seriously break these terms. Where reasonable, we tell you first and give you a chance to fix the problem. When your access ends, your license to use Spark ends too. Your history stays on your Mac until you delete it.

13. This website

The content of this website is for information only and may change. Mac and macOS are trademarks of Apple Inc. Other names may be trademarks of their owners.

14. Changes to these terms

We may update these terms. We update the date at the top, and we tell the admins of customer organizations by email at least 30 days before a significant change takes effect. If you keep using Spark after that, the new terms apply. If you don't accept them, you can stop using Spark.

15. Law and disputes

These terms are governed by Polish law. For business customers, disputes go to the courts that have jurisdiction over our registered business address. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in the courts there.
